Hi. Right, so my grandad bought a car about 6 months ago from a garage, a little red daihatsu thing. He traded his old car against it and got a pretty crappy deal but he seemed happy so im not to bothered.

Now today ive just found he has been back to the garage as there was something up with the car he got and they have basiclly from what i can see completly conned him into buying another car! He says they gave him £5500 for his red daihatsu which is what he paid for it but i dont beleive that for a second. He has then paid £7k for pretty much the same car again but silver with electric windows!

Now again he is happy but im propper fucked off as basically this garage is just taking advantage of an old man, he is 87 and in my opinion should not even be driving but he wont be told. I feel like going up to this garage and just laying into the salesman thats fucked him over.

But is there anything legally i can do? I mean because its such a complete rip off.

how much would the car be worth do they even cost 7k new?? sounds like your worried about inheritance lol

Park the red Diahatsu in the side of the salesmans car
Ive come across this before, think theres a 14 day cool down period for things like this. worth looking into though mate.

tbh i'd just let the old boy enjoy his final times behind the wheel. He probably doesnt want any fuss.

Although I agree with you that their probably taking advantage & bleeding him dry!!

There has to be a cooling off period of a contract. Go down there and kick up shit, that's taking the fucking piss.

Like Eck has said up there, sure it's 14 days by consumer law? Have a wee look into it, and go from there, rather than going in all mouth and fuck all getting done.

The cooling down period is for a credit agreement, is it not? If he paid cash then things might get tricky, if he paid credit card then you get protection from the cooling down period.

It doesn't say if he paid the rest up in cash, or if that's a credit agreement so I'm not sure Ed. But it's the same if you buy goods in a shop normally, such as a game. If you're not satisfied with the product you can return within 7 days.

That's usually the shops own returns policy. Most places will give you a refund if you're not satisfied, but it's off of their own backs to do so. The sale of goods act means that it has to be fit for purpose, but it doesn't say that if you don't like it, you can take it back.

It might be genuinely useful to speak to someone like Age Concern or even trading standards because if they are ripping old people off, they are probably pulling the same tricks on other people who may just not know much about cars. It's not on really, so see what you can do

You might also find that other people have complained to Trading Standards. I remember when I bought my 1.0 Corsa from Wystream Motor Company in High Wcombe, it needed a new engine. I didn't realise when I was looking at the car as there was an additive in the oil to stop it somking (thought it just needed a proper service!). I contacted trading standards and they had a file on the company already so it was very easy to get a refund and return the car.

One thing to remember also, you get no protection buying privately, and if you buy from a dealer; if they say it's 'sold as seen' that is total bollocks - you have your rights!

Yes, you have 14 days to return the product if not happy with it, so your within your right to go back and demand your money back.

But he (grandad) is happy with it...........tbh its a tricky situation! I don't think you could have a positive outcome without upsetting the old boy. Basically i'm of the opinion you'd probably have to prove he's not all there to get them to reverse the transaction.

Is it worth upsetting him if ultimately he's happy? :\

He's 87, he's not going to be driving a lot longer, I would leave him to it, possibly say to him if you ever plan on buying another then take me with you as I can get you a better deal etc etc.

My grandads last car was a turquoise blue lada riva, be thankful!

As colin said, if your granda' is happy, then whats the big deal.

If your granda' is of sound mind (which i'm guessing he is) then its totally up to him to decide what he wants to do.

speak to the garage on his behalf.... ask them straight up (whilst keeping your cool) why they sold him the more expensive one.

When you know all the facts - decide what to do. If its dodgy consumer advice will be our first port of call.

No real offence intended, but if he went in to complain about his car, and then got conned into buying another car instead of getting his fixed, he must be a right sap.
