What is the penalty for failing emissions but you have a valid MOT? (ie people with decats who swap them for MOTs)

I've never seen one of these
but this concerns me... my whole exhaust requires changing (you can't just swap the 'cat' or the 'center section'.
As people say, what's the penalty if you get caught and have a valid MOT.

I also want to know this - purely out of interest, of course

Roadside Emission Checks
How is the check carried out?
The test is carried out by inserting a probe into the exhaust pipe and measuring the emissions. The reading given by the test will indicate whether the levels comply with the MOT test standards. If the emissions levels do not comply with the requirements the driver of the car will be given a prohibition notice stopping use of the vehicle.
What do I do if I get a prohibition?
For a minor offence, the prohibition will generally be delayed to give owners a short period to have the vehicle repaired and brought back within legal limits. If your vehicle is greatly exceeding the limits you will not be allowed to carry on your journey until the defect has been put right.
In either case you will have to carry out the necessary repair work and have the prohibition cleared within 14 days or you will be liable to prosecution. You may be cautioned at the roadside. The prohibition notice will explain what you must do to have it cleared. You will normally be required to have a full MOT test.
To enable continued compliance with environmental requirements, VOSA conduct exhaust emission checks in two ways. Firstly, VOSA Examiners carry out metered emission checks at the roadside and secondly certain classes of vehicles that are subject to an MOT Test will receive at least one metered or visual (dependant on date of first use) check per year.

Without a cat, the emissions would be miles off. It would suck having your car impounded for that!

it doesn't say your car will be impounded, it says you won't be able to continue your journey... So I'd assume you could phone the RAC explain the situation and get your car recovered to a garage / mot center / home?

my C20XE corsa did once too But yeah, Paul, its still a pretty major inconvenience having to do that just for having high emissions. Don't see why they couldnt just give you a rectification notice?

My 106 got through the mot with a loop hole, in the MOT book is states any car before a year (cant remember what year exactly) doesnt need an emissions test if it has a non standard engine change. Could apply for people with xe's aswell.

Just had my MOT (without the decat on) and the guy I was speaking to said that with a decat on it doubles if not trebles your emissions
It's very rare to see those people doing roadside emissions tests though

As long as you can prove engine precedes cat regulations then no.
