I was looking at a phone on eBay, and considering the bidding hadn't got off the ground, I questioned the member regarding a Buy It Now price/what they'd end the auction early for.

He said way over the odds, so I thought I'd try my luck and bid as normal in the auction. In this time, I had sent plenty of questions regarding the phone, got satisfactory answers, even down to him saying he'd sort out warranty issues as it was a work upgrade that he didn't need etc.

I thought all this was normal, plus he has 100% feedback. Anyway, I lost out on the phone. Then later in the day, I got a 2nd Chance Offer, because the winning bidder was supposedly a scammer. This offer was £10 more than I had in mind, so I thought why not. I then paid via PayPal bank transfer. This all happened Friday to Saturday. The 2nd Chance Offer on Saturday had quite a lengthy message where he told me about the scammer etc.

But now, I haven't heard ANYTHING from him, and in theory I should have because I believe it's through his works email as previously he's said "Sorry I didn't reply, I've been away from my desk all day".

The phone was £150, and brand new from Play.com was £180, so I'm beginning to regret going down the eBay route, if it's going to give me trouble.

If I have been scammed, am I likely to get my money etc back?

Only you would ask about a warrenty issue for a phone from ebay

Send another email asking for responce. If no responce in say 3 days (state this on email) open a dispute with gaypal.

To be honest the second chance thing is getting more and more common. People end up bidding themselves on their own auction (using a different account) in order to try and raise the ammount the actual final buyer will pay. They often fuck this up and win their own auction themselves so will probably send the next genuine bidder a second chance offer.

I wouldnt worry about it too much yet if his feedback is good and youve actually had valid communication up to now.

Yes you'll get your money back from paypal as in disputes Paypal will almost always side with the buyer unless the seller can produce a valid proof of mailing your item to you.

He has 53 positive feedbacks, making it 100%, but has been a member since May 2003. This doesn't bother me massively, as I don't sell much on there myself.

It just seems very very peculiar.

It seems the winning bidder initially was from the US, so probably why he classed it as a scammer, 'cause he would only post to the UK.

I've bought a few things, paid by PayPal and you don't get a single message from the seller, the package just arrives a few days later.

He'll have your address from the PayPal payment, so he put's it on the package, in the post, forgotton about.

You don't half do some worrying you

He hasn't told me when it'd be sent or anything. Simply sent me the 2nd Chance Offer, I accepted, and paid.

tbh, may be it's just me that I like to keep good communication with buyers & sellers. I guess it's the business and PR which has been drummed into me over the past 5 years.

However, I'd understand it if I hadn't send emails, but I have a sent a few. Would normally expect a reply from 1.

This is the auction, make of it what you will:

I never send a message to say I have posted anything unless the person asks. I'd leave it a few more days.

I bought some lights on the bay and it took the seller 7 days to contact me (only because i said i was going to report him) He got shity, the lights came through, they were listed as good condition when infact they were shit! scratched chipped and a 2" crack in one of them, so i messaged him and said to be honnest about condition next time and as for the lights they are in the bin, he then called me an unapriciative twat........
Fucking lol
Ebay is full of pricks, give them 4 days to sort it or tell them you will open a dispute. simple.
