Right my mum bought me a phone for christmas from the carphone warehouse.. cost her £180 it was the LG Chocoloate..

The other night the screen turned yellow and blue, and then went white and wouldnt allow me to do anything with it. It now does this quite often and doesnt start working for a while.

I still have the receipt do you think they'd be able to replace the phone? Or give a refund? As i have not dropped the phone, and im puzzled to why its happened.

make sure nothing has happened due to condesation/liquid etc...

If this happened and they take it for repair, they can say they won't replace it if you dn't have insurance

i had my ericsson k750i from there and it broke within 3 months, i it depends if you have insurance or not, if you do they will replace it if you dont, they will take it in for repair like mine was even though i kicked up a massive fuss and they didnt take any notice and still said no insurance no replacement so it had to be repaired, takes about one week or two depends if you take it to an express centre.

When I took my 3310 back to Link after it kept turning itself off the would upgrade it but wouldn't exchange it, they said they would have to send it away. So you may have them saying they want to send it off.

Its a repair warranty, so I doubt they'd just replace it

You can request it to be swapped, but they don't have to

they will have to repair it, if it cannot be repaired they can replace it or offer you a phone of the same value (*current value, not when it was bought if i remember correctly)

if it has the same fault again then they shoudl replace it

Ive dropped phones, filled them with water and done all sorts of stupid stuff and still managed to get new ones for free. It's in thier best interest for you to have a working phone

Dont be puzzled, you have a shite phone with piss poor reliability. This is what happens when people have a 'fashion accessory' phone, i know someone with the same phone that went all spakka on her, some other people with tiny 'fashion accessory' motorolas and samsungs as well.

get a SE or a nokia.

but the contract of sale is with the shop, so it is the shops responsibility to have it repaired or replace it as stated in the sale and supply of goods act

but you dont have a "right to demand they replace it"

they have the right to attempt to fix the fault first, dont go in all guns blazing and demanding, when a customer did that with me i was just a right cunt back to them

incorrect. contract is with service provider-the shop are merely agents-any Phones4U, carphone warehouse or other mobile shop do not sell contracts-they merely advertise them. we have loads of complaints everyday about p4u and cpwh-but legally all they have done is supplied a phone from the manufacturer.

its like buying a 6 month old car from a bloke down the road and taking it back to him when it breaks-it dont work like that-u take it back to the manufacturer.

actually ur incorrect, from a legal stance your monetry contract is with your retailer, so if u purchased the phone from phones for you then your contract is with them, ur comparison with a car is wrong.

if you buy a new car from a dealership or something and it goes wrong then ur contract is with the dealership NOT the manufacturer
