I don't know if this is a repost but has anyone seen this yet?
Will this set a precedent for any future claims?

Again...sorry if it's a repost

sounds like the judge is a nob, and either wants a bit of publicity or hasn't got a clue. lukily;
As this judgement has come from a district judge, it is not binding on any other court, in the way that a High Court judgement might be.
so doubt it will set a precedent, the fees are unjustifiable, the guy claiming must have had a poor solicitor for him not to be able to argue that.

My thought's were similar to your with it being a district judge.
My letter is currently being dealt wiht by A & L so i was kinda hoping it had no effect on my claim .

It will begin to have an affect...
now that a judge has held in favour of a bank, banks might not pay out refunds as easily

The banks won't be handing out refunds so willy nilly in future now they know that there's a case not to.

the first step for banks charging people a fee to have an account with them...The words used are 'the price of the services provided by the bank'

i think this will make banks think twice about taking it all the way to court, we'l probably see a lot more cases go to court now.
However i can see this being a one off, and he might even win his appeal.
Any judge worth his salt wouldnt have given this

Why? it all depends on his personal interpretation of what is deemed as a fair price for bank charges in the first place, if he thinks 30 or 40 quid a time is a sufficient compensation to the bank then that's his own opinion.

so the office of fair trading is incorrect, yet a county judge who just does this kind of thing in his spare time with litte legal knowledge on the subject knows better?
id say it was a publicity thing

his opinion stinks then 40 quid charge for something that would incur a max of 4 quid admin charges. Talk about kicking people when they are down, and rubbing salt into their wounds, thats sheer bum rapage!

county judges have zero legal knowledge, they are just pensioners who do it in there spare time lol, they are only required to know about what penalties are issued for certain crimes, most of the time they take advice from there assistants

IMO when you open the account you know that going overdrawn means you will incur charges. I don't go overdrawn so it doesn't cost me anything.....I don't see anything wrong with the charges - its how they make their money....

if you read up on this case though. iirc the bloke didn't get the evidence to show the charges. so he had nothing to back up him claims.

most banks make there money from loans and credit cards these days, banks are not meant to profit from your current accounts
