17th june had 4 people in my pub, one of which was in a wheelchair (we've recently found out he wrote his car off driving too fast and has paralysed himself from chest down). anyways they were all aged 18-24.
Had been in drinking for about 4 hours, and both him and his girlfriend were very drunk, they were singing, swearing, shouting and annoying customers around them. As wetherspoons has a sensible drinkin policy, we decided that enough was enough, and told bar staff to refuse them service.
5 mins later the girlfriend went to the bar, and was of course refused service, to which she reacted by threatening the lad behind the bar, calling him a 'stupid fucking cunt' and saying her friends would 'do him in'.
So i stepped in, and got the same abuse back. To which point i told them to leave the pub, as threatening behavious is an automatic barring offence!
They wouldnt leave so the other manager on duty threatened them with police action, so they soon left. 5 mins later the boy in the wheelchair returned alone to talk to myself and tom, the other manager. he started accusing us of being discrimative towards him, saying we just wanted him out because he couldnt walk etc, and continued to swear at us and threaten us. this went on for 20 mins. (Both my mum and the other managers mum are disabled and cant walk un-assisted so we are far from being the type to discriminate).
Anyways he left eventually and thought this was the end. Now to find out today that the lad has decided hes taking us to court, claiming that we called him a 'spacka' etc and told him we didnt want 'his sort' in our pub 
his friends are taking hsi side as witnesses, we have about 6 staff witnesses that this was not the case, however we've been told we'lll prolly lose the case
Can anyone shed any light on this?? they were utter chavs!

What a fucking tosser. If you have as many witnesses etc as you say you do, i reckon you will be fine. You should have crippled him again.

How will you lose the case, I can't even see how it can actually go to court with no real evidence, it's just all 'he said, she said' crap? 
And what would actually happen if you did? A fine or something?

You will need to get a sollicitor and advised
But the claimant will have to prove his claims and the court will decide on the balance of probabilities. Their word against yours/your friends.

from what the area manager says, it WILL go to court, and we WILL pay out a lot of money. End of the day, if it drags on, bad publicity for the company.
the mother is claiming all this stuff about how he will no longer leave the house hes so ashamed that people judge him becuase of his wheelchair etc! its all a ploy to get cash as it prolly cost him a fortune writing his car off`

Oh thats another thing, they'd been in drinking for about 4 hours....well when we said he was drunk, his girlfriend said 'hes not drunk, hes on a lot of medication' to which the other manager pointed out that if this was the case, he shouldnt be drinkin, especially not so much....theyre now kicking off saying how we shouldnt be telling him whether he can or cant drink on tablets etc! its crazy!
End of the day, by law we have the right to refuse service to ANYONE we want, for whatever reason we want. its also against the law to serve someone we think is intoxicated.....no win situation

Lynny I was thinking that, about medication. Do you have photo proof of him actually drinking? That could land him in shit if hes on benefits.

it annoys me that the company will prolly back down and just pay out, in our pub we have at least 30-40 disabled customers in every day, and about 80% of them are regulars who come in at least once a week! as mentioned, both my mum and other managers mum are both disabled, how can he accuse us of discriminating!

that's the point and I guess it's one of the main argument in the present case.
Isn't there CCTV? or anything recorded?
Were they threatening? (physical threats which might show on CCTV)

Like you said at the end, you have the right to refuse service to anyone, so at the end of the day, and it's illeagal to serve people you think are drunk etc..etc..
So in theory he hasn't got a leg to stand on (forgive the pun).
But like you said it is bad publicity and people will jump to conclusions if they read about it anywhere.

CCTV doesnt show anything threatening as it was all abusive language. but does show the fact that they were in the pub over 4 hours and can clearly see them buying pints etc.....

we've tried all these arguments, yet the powers that be say it'll be better off paying them off before court. end of the day, poor little disabled boy who became paralysed at young age, or big bad company, who willl people take pitty on?
i want it to go to court, and i want the argue it out! im fuming about it!

To be fair, it's not illegal to go to the pub if you're on benifits, even if you're on medication and/or paralysed.

I would think that his mates will not be counted as credible witnesses, as they are his mates. Same for his Mrs. So, therefore they are no proper witnesses.
If the company will pay out to stop it from going to court, more fool them.

Anyway, what I meant was, saying 'look, he's on benifits and is drinking' wouldn't go anywhere.
