before i take an offical line with someone on this just wanted to know basically where i stand in terms of legality.

Paid £135 for some goods through paypal 2 months ago.

The weeks start rolling by and no item arrives, cue excuses from the seller such as "sorry had delays etc".

After a month i raise a paypal dispute, seller responds saying that he will send it soon.

Another week goes by, so add more notes to the dispute, seller states that he has sent it.

couple of weeks on, no item.

emailed seller requesting he sends me A) The address he sent it to and B) the tracking number and courier details (special delivery was part of the deal). get an email back mumbling about how he will get the numbers of the receipt, whatever that means i have no idea and he doesnt confirm the address he sent it to.

now he is not responding, the paypal disupte autcloses after a month and on the site it doesnt let you reopen it.

ADVICE please, where do i stand on this?

Take it as far as you can and let paypal investigate it for you thats what they're there for. I had a similar experience and escalated it to a claim, i kept all the sellers e-mails saying what he had done and was doing to prove he wasnt doing this. He didnt have a leg to stand on, next thing paypal had refunded my money and thats the last i heard from him.

Have you escalated the Paypal dispute to a claim? If not then do so.

Im not going down that road of pretending to be a gangster and doing visits to threaten people.

I want a legal resolution to this issue, im £135 down and cant afford just to throw money away like that.

will be emailing paypal in the meantime if i can find out who to speak to, they dont make it easy for things like this.

the dispute autoclosed after about a month, shows how repsonsive the seller was to emails etc. Now it wont let me reopen or escalate it, the paypal site is a nightmare.

Right paypal has been contacted to reopen the dispute so i can escalate to a claim.

Ive also been tipped of about the seller, including pieces of information that makes me sure he is 90% taking the piss.

You are warned when raising a dispute to a claim that it will auto-close after a certain time

If all he does is respond to Paypal's emails then there's not a lot they can do to be honest.

I would threaten legal action yourself if you don't receive either the goods or the money right away.

Oh sorry SetH I thought you meant that it would be autoclosing soon

Hope Paypal re-open it for you or I don't know what to suggest, turning up on his doorstep might be an option, you don't have to do anything because tbh, from the pics I've seen of you, if I owed you money I would shit my pants and pay up if you paid me a visit!

got response from paypal:

Thanks for contacting PayPal. I appreciate the opportunity to assist you
with your questions.

If a dispute is not closed or escalated within 20 days of it being filed, the dispute is closed automatically. Once a dispute is closed it can no longer be escalated to a claim for PayPal to review and the
transaction is not eligible for PayPal protection coverage.

Thank you for using PayPal for your online payment needs.

Sincerely,
Claire

I might as well have just sent fire to £135 for a laugh.

Paypal/ebay are fucking shocking. They keep raising their prices, making billions yet are piss poor useless when you need any form of help. I don't use paypal or sell on ebay as it's become a joke and I refuse to line their pockets Not really sure what to say mate?

simply go to the police and make a statement explaining the facts and esp how payments were made

and the police will contact paypal for more info

you can also make a money claim online:

https://www.moneyclaim.gov.uk/csmco2/index.jsp

btw is it for the tomtom?
