i got a letter of barclays the other week saying that i was overdrawn by a £2.59 and i was wondering why cos i never go overdrawn and always know how much iv got in my bank. so i phoned them up and they said that i paid for something at a BP garage on the 11th july. i remembered exactly what i did that day and knew i hadnt been in BP but nobody would believe me. sad as it sound i even got a bollocking off my mum and even she didnt believe me. well i got a reciept from BP and it says that i spent £2.59 on the 11th of june. this morning i got my statement through and it says that the £2.59 was paid out on the 11th of july so i was right all along. i paid for something with my card on the 11th of june when i had money in and the garage a month later charged me for it when i had no money in. is there anyway i can get my £30 back? and should i just ignore BP or should i give them a mouthful for wasting my time and money
i knew i hadnt gone overdrawn and no1 believed me
rant over

i wouldnt be too bothered to pay the charge if i had gone overdrawn. just pissed off at the fact i had money in my bank when i bought the items. but the garage charged me a month late and that made it go overdrawn

Its not the banks fault that you spent their money. You didn't monitor all the outgoings of your bank account you overspent. Sounds harsh but its true.
I think the fine is a bit much for a few quid but if you had gone over by £50 the charge would be the same.....

i can see what dayzee is saying. i should pay attention to what i spend exactly and should had realised that on the 11th of june £2.59 did not go out of my account but still, BP are in the wrong in my opinion and the bank should see this and let me off. il go in 2moro and let you all know the outcome
im off out now, but cheers for the help

The bank can't charge you that anyway.
Read barts thread and there is at least one from not long ago.

iv got the lowdown on all this now.
Banks can charge you for the costs it incurs on them for you going over the limit, however £39 or whatever it is is way more than what it costs them, and is in effect a fine. You can only be fined by breaking the law so as such these charges or fines are illegal

With HSBC, they charge you £18 every time you go into an "unauthorised" overdraft, up to a maximum of £60 a month IIRC.
£30 from Barclays is quite steep. If I were you, Mark, I would lodge a formal complaint with your bank, and demand to know why the transaction was not completed at the time. They should refund your overdraft charge then.

no unless you have broken the law they cannot charge you more than what it costs them, as this is then classed as a fine
small print is not law

Yes but they did, and I think you'll find they're probably entitled to aswell. Regardless of having the funds at the time of the purchase the date the payment was taken there was £2.59 less than required. Therefore, he spent the banks money. In a perfect world he would have kept all his receipts, did his books at home and know exactly how much he had spent, how much had been taken already and how much was left.
Its a shitty world and things should have gone faster, but they didn't. This is how I learnt not to fcuk with the bank and I'm sure how most people do aswell.....

But the bank can't charge him that anyway so it doesn't really matter.
It is illegal on the bank's part as already mentioned.

Just spoken 2 my mum.
She said that BP are entitled to 6 months to take the money from your account, stupid, i know, but they have 6 months.
She said don't go in to have an argument, explain the situation, and she said they might as a good will gesture, get rid of the charges etc.
