right i work in a pub in the biggest shopping centre in the country, well today a good friend of mine has found out that they are facing a disciplinary, which will lead to being sacked for gross misconduct, aswell as legal action as they served someone several pints, who then drove home and got pulled for drinking driving on the way home. officer has said that because he was served alcohol, the person serving is liable!! how fked up? we're not to know how customers are getting served, i alone took the best part of a grand today on my till, average order bing £10'ish, theres no way im to ask every customer through the day how theyre getting served! discuss.....

Very harsh, only way you could be sure was to ask everyone drinking to surrender their car keys.

iv had people use their car keys to point to the drinks they want before, asked if they were driving, they said no, nothing more we can do than that

it shouldnt be the bar's responsibility anyway, if you asked "are you driving" and they said "no" then you said "i think you are, so im not serving you", YOU'd get fired.

thats the most ridiculous law ive ever seen.

why would we get fired? we have the right to refuse to serve anyone we like for any reason (except race etc)

mate isnt gettingg wound up, theyre currently suspended.

not being nasty lol, but on an average day i refuse to serve about 20 people you realise hwo many complaints i get against me? been to 3 disciplinarys myself. luckily 9 times out of 10 managers back their staff up and i have some excellent managers

unfortunatly there are some very silly new laws, i know that you can get fined if you knowingly serve someone who is drunk

Never heard of any law like this before...dosent make sense.

In theroy it is illegal to serve a drunk man alcohol but one pint can be enough to be over the drink drive limit.

Dsoent make any sense to me

our manager has kicked off saying hes never heard the law before (being pub owner for approx 10 years he knows the liquor licence laws inside out) but even he is facing bother because of this etc! theres uproar!

where do you draw the line for "drunk"? i mean, how do you know when to stop serving someone?

just slightly giggly? or struggling to stand?

its down to the person serving to decide, things you have to look out for is failure to focus, slurring speech, lack of balance, attitude, etc. its quite shocking how some people can react when they get refused service as theyre too drunk. same when someone is under infuence of drugs

end of the day rob, say you get a customer coming to the bar, chav or whatever and you dont like the look of them, theyre young etc. you ID them, they have a bit attitude with you (not enough for you to refuse service but they annoy you), we will serve them a drink or two, then use the intoxication law to our benefit to refuse anymore to get them out of pub

serving an intoxicated person is an arrestable offence and person serving recieves an on the spot fine

I am not saying you're lying lynny btw, i'll just point that out 1st.
But this sounds rubbish.
There is not a chance that would stand up in court.
Following that logic I could buy a crate of tennents from asda, get pissed, drive into a lampost and get arrested, then say its not my fault because asda sold me it.

as i said, its down to the person serving to decide if they consider the person to be intoxicated. even if they dont show signs but merchant is aware of the customer having consumed a large amount of alcohol, then they must refuse service
