how can they become illegal?

When your car is serviced they fit a cooper on or equilivant. This is effectively aftermarket too, and K and N panel filters are good value (as replaceble) alternative.

There is no way you can define an after market ait filter. They need replacing every 10k, so every car will have one pretty much.
