Not me personally but...we had a new fireplace delivered on Monday, just come to move it now to install it and its cracked in the middle when being lifted. Its a solid stone fireplace and was lifted at either side by two people (so wasnt put under any stress to break it) so obviously had a fault.

Phoned the company and they are just saying to buy another and they dont really give two shits.

Have I any comeback on them?

Ask them what sort of quality control measures they have in place. If they reply with something like the guy makes it and punts it out the door, then you've got something to work with. If they say they do some sort of checks on it, ask for proof. And if it turns out they have that sort of thing I think they'll claim it was lifted improperly/ damaged in transit.

if you signed for it the chances are you dont have a chance really, 99% of people just sign a piece of paper without reading it, but signing the paper is a way of you confirming that you recieved the goods in perfect condition.

I'd guess this is worth a good bit more than a front grille or something someone from parcelforce wants you to sign for.

Would guess the company it came from would have arranged delivery?

Yeah I think so. Its not at mine, but doubt whoever it was who took the package checked over it.

By the sounds of it you couldnt even tell from looking at it that it was cracked, as was only when they unpackaged it all and picked it up that it went.

Bought on credit card? Send it back & get them to reverse the transaction.

That isn't legally binding though. When I worked in TNT we had people do that, then break stuff on purpose to try and put claims in. If they ever made it to court they would get fucked off as they signed the delivery and therefore accepted it. no matter what they write on the POD.


I would rather lose by a mile because i built my own car, than win by an inch because someone else built it for me.

could always try the whole trading standards act and say its not fit for purpose (and all manufactures have to give a years warrenty dont they?)

god knows tbh.

could always do what collin said but without sending it back (happened to one of out clients even though they had proof the bloke signed for it they still gave him his money back and ignored the company - so they ended up 1k down )

the problem with solid stone is that its a natural product and no two will be the same; the slightest fault line could have been made worse whilst the stone was worked. all it took was a bit of extra pressure and bang its broken. You wouldn't even know it had damage until it was too late

However, for the company not to accept it back or to not even try to come to a mutual agreement is bit off really
