Scottish law is slightly different, but not hugely.

The proculator fiscal, the person who decides weather you go to court, what your getting done etc.

Understood, but isn't the punishment a bit harsh? I would accept a fine etc, but being ban for that is pretty weak. I had another car insured, i had no intention of breaking the law.

It is harsh indeed but you don't get anything less than 6 points for insurance related stuff now but the court may be ok about it and just fine you.

Ah right.

Down here you'd have a got a £200 fixed penalty & points instead.

i would go to court with your mot and insurance document showing that the car was moted the day after and insured, texed and that you were just cleaning the car ready for mot and tax! be polite and just explain situation and i think u will be ok!

i had 7 written complaints againt me and doing flames on public roads, off duty copper took me to court i didnt go but they rear summit out that i wront in court!

just said i understand now about doing flames was wrong but i was part of the show scene where its ok to do off road! i took the device off straight after hearing of complaints and as u can c i have receved no more complaints!

bla bla bla,

no points and just 93 quid fine! happy days!

was in paper for doing 6 foot flames infront of bus, whoops!

i used flame kit EVERYWHERE and could make pretty big bang noises which on some occasions made people fall over from shock, cos it sounded like gun shot!

the took me to court over having a car being driven with defect or something like that, thing is when i got pulled over and interviewed etc they dident even give me producer or get me to take to mot centre to get it removed! i disconected it when i was pulled over co luckly i could not do a flame when the police asked me to for camera for evidene, i forgot to mention it injected butane gas into exhaust also just said ti was excess fuel!

didnt even empond my car, happy days!

What would they do if your dad was washing the car? Prosecute him?

I'd try court, contact the papers and get ready to pay the legal costs.

Speak to a solicitor and take it to court that will get thrown out.

Did you move your car at all because I'm pretty sure they can't give you points for not having insurance unless your actually driving the vehicle?

you can go into a solicitors and they will give you half an hour for free. take with you any paper work (insurance of all cars, mot's etc etc), they will be able to tell you the best way to go. i would imagim=ne they will tell you to go to court but get yourself a duty solicitor which is free and im pretty sure this will get thrown out as it was a genuine mistake. infact it will probably be the copper who ends up looking stupid for wasting the judges time with such a stupid offence!!

good luck, im sure you'll get nothing appart from the judge telling you to be careful next time.

i deffo wasn't caught driving it, the offence is simply having it on a public road with no insurance, like i said the police ohh don't worry this'll just get chucked out, a fine i couldn't care about, and some points, but why should i get the same fucking ammount of points as some badger driving about with no insurance :@

cheers for the help btw everyone
