We were both coming from the A1206 at the bottom of the picture. Before the roundabout we were stopped at some traffic lights both of us on the left lane (him infront, me behind) and as the lights turned green he joined the middle lane of the roundabout poodling at snails pace, so i decided to move out to the left lane after i passed the trafalgar way junction to leave straight on (A1206 North). However at the last minute, the guy decided to brake and cut into the A1261 junction right at the last minute hitting my rear wing and alloy wheel. The damage doesnt look too bad as most of the damage went to my rear wheel arch, alloy and scuffed my rear bumper!
Judging by the damage where i had been hit, he must be at fault:
1) Majority of the damage suggests is to the rear wheel arch which obviously pin points that he hit me and i was ahead of him.
2) Last minute decision cutting into the junction which caused this whole accident.
3) If he was in the middle lane then surely he shouldnt be making last minute decisions to cut through the junction like that when my vehicle was already ahead of him.
P.s Im the blue line btw!

Are there any lane markings?
I'd hazard a guess at that going on for a year then being 50/50.

If hes crossed lanes then hes at fault...simples!! Was there not any witnesses?

he should have been following the same path as you, then turning off, not going on the outside of you then turning into traffic!
easily his fault but if there are no witnesses then its probably 50/50 your word against his etc etc,

Well most of my damage is to my rear wheel arch so everything points to the fact that i was ahead of his vehicle (doing 30). Yes he did cross lanes and this roundabout is notorious for being a bit complicated but if my damage shows that my rear quarter panel was hit then it suggests that he crossed without looking whilst i was ahead of him?

Thanks for the advice Ollie lol! Im guessing this one will be hard to argue but i was thinking the damage to my car will point me being infront of him and he cut across without looking!

if the damage is on the side then it could well go 50/50. if it was on the rear corner then it would go your way.

Thats the thing, i was expecting it to be his fault and not 50/50 purely on the basis that the damage was done to my rear wheel arch/alloy wheel. If the damage was done to my front wing or passenger door then it would be a complete different story e.g. 50/50

just to cofuse you even more (because claims are a very strange thing :lol some guy pulled out of a roundabout without giving way to his right (where i was), i was already pulling away and he come across quite fast in a mondeo st220 and i had to brake and hit the corner of his rear bumper.
that went 50/50 because there were no witnesses and it was on a roundabout even though it was clearly his fault as he didn't give way.

Alloy wheel is all scratched up, the rear panel needs a respray and the end of the panel is bent in
