Need some help on this 1. Yesterday i was pulling out of a side road which joined me onto a slip road which comes off of a dual carriageway. I didn't come off of the dual carriageway i was coming out of a side road.

When i got to the slip road i looked down on my left to make sure no one was walking up etc. In order to get a good clear view of the road coming down from the right i had to creep forward a foot or 2 as there was a car blocking my view and also to make sure i had enough time to get out as the road is 40mph.

As i was about to leave the junction when the coast was clear a silver car came reversing up the slip road and we collided. The front driver side of my car had caught his front passenger side wheel.

We got out exhanged details and he said it was abit og a grey area where we were and left. i then got some witnesses details who saw it happen.

By the sounds of it my insurance company are saying i'm to blame for the accident because cars on the main road had right of way and i was over the line, but this guy was reversing up the slip road?????

I'm the smaller arrow and hes the larger and the circle is where we hit even though its into the road... i don't know why i put that tbh.

He'll be at fault for that one.

I read that road as a 1 way street, a sliproad off.

Anyone who's seen police tv, knows how they LOVE people who reverse down junctions.

Keep at it, demand your innocence. Your in the right, he is in the wrong.

Sounds like you had a goon on the phone.

I have been told you are allowed to reverse 1 car length up a slip road? Whereas other people said you are not allowed to full stop.

Like you say i'm gona have to fight my case it seems! I may even have cctv evidence from the building on the left of the road i came out of...

Think the highway code says don't reverse further than necessary? why the hell would you need to reverse on a slip road any how? What an idiot!

Not sure if he was trying to join the main road again, but he could have done that at the bottom of the slip road...

This is the reason why they have also supplied me with a mother f**king 1.1 fiat panda... because my insurance are thinking its them thats going to be paying so supplied the crappest cheapest thing they could find!

was he reversing in a bus lane?

check the times of which the bus lane is operational perhaps? if he's in the bus lane when he's not supposed to be, you'll win.

yes the only cars i saw parked were further down in the bus lane which is on double yellows anyway. thnaks for info

Hmm hard one...

One the one hand, he shouldn't be reversing up a 1 way slip road the wrong way... HOWEVER - that is a seperate crime in effect.


You should give way to the main road traffic and you clearly must of creeped out over those 2 'Give way lines' as seen on the map...

So you didn't 'look' / give way correctly... (naturally you normally wouldn't look left in that situation)...

Hmm, hard...

Technically you are in the wrong.

He's also broken a law on the road, but that's for the police to prosecute him for it, rather than have any consideration in the crash.

However, I'd re-write your story so it reads...

'I was pulling out of the side road onto the slip road, once on the one way slip road the guy reversed into me.

imo then he'd definately be in the wrong as it'd be the equiv of him reversing up a one way street the wrong way into you.

Hmm yeh i see what your saying there paul thanks.

The only reason i crept out slightly beyond the give way marks was because if i didnt i would have not had a clear view of the road i was turning into because of the parked car. and like i say the last thing i want to do on that road is assume its clear and have someone wollop me at 40+mph

don't get me wrong mate... I think you're in the right in all respects and would be pissed off if it had happened to me...

Just think 'the law' etc will see it as it technically is written in the law... which sucks.

I take it that it was the car that was reversing that hit you? If your indenpendant witnesses will vouch for this then he'll be at fault.
