Hi guys, I was in Liverpool yesterday and was pulled cos my car had no insurance....right well heres the story
I bought and insured the car 1st August 2008, it was on a private reg.
The private reg changed to another number plate while I was away for 3 weeks in India, ive only been back couple of days.
The private plate is on retention and the P plate I had on was not insured as I only just recieved the V5 documents, so therefore the car was NOT insured under the P plate but I have full documents etc
The car was then seized, just got it back for £150 plus needs MOT doing so its in for that.
Im writing to complain to Police as they searched my vehicle with no indication or permission from myself. I was totally calm and relaxed and answered everything but they still did not belive me.
They checked the private reg and it was on retention but I am insured to drive it!
any advice plesae?

Are they actually prosecuting you with the IN10 or are you just in dispute of the release fee?

You'd need to make a claim on the policy which you bought and see if the insurer honours it I would have thought.
The recovery charges may be more difficult to get back though. The holding garage will have levied the charge and the Police merely passed it on. So the garage did store the car and so they'll want paying either way.

If you haven't got any points (an IN10 - 6 points and a big stain on your record), pay the £150 and walk away if you weren't insured.

There are two issues, the insurance caution and the recovery fee. I think you should be OK with the insurance but not hopeful of getting the money back.

what is the issue? the search of the car? the stop for no insurance? or the fee?
what grounds were given for the search? they should have said why they were searching it. The £150 fee is std SOCAP fee now, paid to recovery firm. If you did not have valid insurance for the vehicle and the correct registration plate then it should not be driven. What did they say to you? should have been told you were being reported for driving a vehicle without valid insurance. were you given a producer etc?
