I knew I was being overpaid

I know i'll have to pay it back, they're just not getting it off me in one go if I can help it.

I doubt they could force you to pay it back in one go, but its probably best to come to some agreement with them outside of court proceedings as otherwise you'll have it held against your name for a good while.

If it was over a long period as easy that you could of not realised you were being over paid (even though you did) then its one way to bargin with them to let you pay it off over a set amount of time.

I wouldn't let it get to court anyway, i'd pay it if it was getting anywhere near that.

I sent a quick letter away saying they had got their calculations wrong for a start and that i'd pay a bit, i'll update with the reply.

It's hard to kid on I didn't know since I only worked for them for 3 weeks

Exactly, but the law is (and it is twisted like you say) very much on the side of the employee rather than the employer - especially when it comes down to such a small amount as £107.

I may of overpaid someone a few weeks back to the tune of £1200 so know a bit about it
I also did that once, a startling similar amount She tried to argue she didnt realise She was soon put in her place

Yeah agree with Cosmo, can't see them complainign about instalments although watch for them legitimately adding itnerest (they will have to as its over £5k... BIK rules etc)

colin if its falkirk council, phone the pay roll department in the municiple buildings, and ask them clear it all up for you, everything should be on record, so they will have the ins and outs with it all,
but be prepared tocall them a good 2 or 3 times, with out fail week in week out theres allways someone in the section i work in has somthing wrong with there pay, and its never sorted out with the first port of call

if that fails then i would say get some legal advice on the matter, i wouldnt back down to it though as having been working with them for a good while iv relised there chancing badgers
