Ordered a remote control car online from a shop down south back on the 30th june 2008 , basically it turned up brand new, anyway got it out tried to start it and it wouldnt (rang the shop and told them it wouldnt start at all, he just said try this and hangs up, so didnt really help me at all), still wouldnt start so found a local shop who deals with hpi took it to them and told them the problem (really helpful place) told me that the carb had been put in backwards so changed it for me (didnt have to take anything apart really just had to adjust a screw). got it home ran it about twice and the idle control screw fell out and went missing. (took it back to the local shop and asked if he had one. (they dont and i need to order one (will be free from hpi) but still he said that they should never fall out at all.

so basically im now feeling like iv got a shite rc car thats going to keep breaking on me.

i've just emailed the shop i bought it from and told them all the above and asked for a refund. is that wrong?

1) who reacons i will actually get a refund? (if they say no what can i threaten them with in order to get one)
2) is it too soon to have asked for a refund?

to summarize for the lazy fookers.

bought rc car > broke twice (2 manufacturing problems) > asked shop for a refund > awaiting reply.

They should give you a refund to be honest. In my experience its best to just keep customers happy in business. I ordered a new key for a man recently. He broke it off in the door lock. He moaned so i got him a new one for free. His error tbh, but sod it, hes happy lol

yeh i agree (what argos used to do when i was working there ) but i have a feeling they are going to say no

not wrong at all mate,they have built it so if it breaks your enttled to one.phone citizens advise/trading standards to see where you stand

well it isnt the shop i bought it from who built it so its not their problem as such, thats why i can see them saying no. oh well.. will wait fora reply and see what they say the go through trading standards if i need to etc

Distance Selling Regulations means you can return in 7 days from when you received the goods so long as you can get it back to them. You're entitled to a refund of the cost of the item but not shipping either way. It can be more then 7 depending on whether you were advised of their terms in writing.

If you can prove that the fault was present when you took delivery then you would be better using Sale of Goods Act which means you can return without cost to you. You've used it though, which means you'll have a hard time proving that it wasn't fit for purpose.

Would there be any reason why it can't be fixed and kept? I don't think you've legal grounds for return but the company may well do so as a gesture of good will, but you'll still need to replace the car from another supplier. Are the local shop able to oblige?

what do you mean?

i would ideally like a refund as its broke twice within the space of a month of having it (one was a problem straight out of the box, the other was after use.)

it could be fixed this problem i just dont want to keep it and find out down the line it breaks again and then be completely stuck with it.

still not had a reply to the email

go away tomorrow for 2 weeks, so will have to wait till i get back (if i havent had a reply by then i think i shall be moaning a bit more )

edit: rang them just and asked if they had recieved the email, turns out they have had email problems this week. so asked me the problem told him and they dont have the part in but said they will get it in but it will cost about £5 for a screw

think ill wait till they've read the email and replied. (should be sorted this afternoon apparently)

right... never had a reply to the email i sent (went away for 2 weeks, a week after i sent it).

so came back and decided to get the idle screw and got it set up so it ran....

picked it back up thursday night and bin out with it today (3rd time iv EVER used it in the 2 and a bit months of owning it)

and IT BROKE

something off the drive shaft has broken off so it has no drive

so 2moros jobs are 1) ring trading standards and see what they say about it all then 2) ring up the shop and ask for a refund or what ever trading standards say im entitled to.

is it STO models or something like that? if its the one i think of they are a bit of a bunch or badgers i went in there and they were useless and tbh just annoying ended up just going to another shop

yeh it is them, im ringing trading standards 2moro and possibly hpi before i ring them so i can basically say 'just give me a refund'
