i was driving dow the road to the city tip, to throw some shit away, some nobber overtakes me, and a copper sees it, pulls us BOTH and gives us a cuation under section 59 and said i was racing, i tried to correct him, saying i was just driving down the road and he did me anyway, fuckin nob, no wonder police have a bad name

I think a strongly worded letter is all you can do to be honest...you wont get a reply and they wont care. But at least you'll have done something about it.

appeal it, ask for evidence of racing, and breaking the speed limit, request onboard camera evidence if they have it.

im sure they will drop it

Ha ha, my tax disc fell off my windscreen the other day and I got stung with a notice for it, (cle2/6 or whatever its called)

Phoned them to explain and find out why the didn't check their database to see if the vehicle was actually taxed, the reply I got was, "we can't spend that much time on these checks, we're crime fighters"

My reply was something along the lines of, "with clearly so little of it to fight that you find time to wander the back streets ticketing cars!"

Am also wondering, does this fact that they are "crime fighters" mean that they no longer have to perform the necessary checks to see whether a crime has actually been committed?

"Sorry we shot you, we didn't have time to check you had no weapon on you, we're crime fighters"

it is an offence not to display tax though, wether the car is taxed or not

Russ, Bit of a strange one that. Section 59's can be given when there is evidence of careless or inconsiderate driving, Driving without due care and attention or an offence of unlawful off road driving. Difficult to tell you why you've been given that without being there.

cle form isn't a fine - it's only a notification to the DVLA of no apparent tax

Upto the DVLA what they do with the info...

when i got a section 59(was driving a quad in fields nothing to do with my car!)
they came to my house, spoke to me and gave me a piece of paper with some writing on it

but if you use your car in a manner as described above, they can still have your car off of you (s.60)
The s.59 warning is on you, not just your car or quad or whatever
