this is the most blatent way of pushing blame i have come across and why i hesitate to use ebay! item picture is not the item i recieved! open and shut case! the item i recieved is for a small block engine not a 2litre engine as described and pictured. the item picture is completly different to what the seller has sent me. started off as a decent ebayer and was carefull to post to the correct address etc but i now believe hes just trying to shift aload of shady stock that he cant get rid of

To PayPal. The customer has advised you that the water pump is for a 1300 cc engine. He has never advised me of this fact. This is the first that I have heard of it. Could you please ask him on what basis he has come to that conclusion when the Unipart catalogue states otherwise. Thank you.

To Payl Pal #4: In a following e-mail, I will send a photo file of the extract from the Unipart manual for your water pump. As far as I can see, the engine applications that I gave in my listing are a correct replication against the Unipart manual. If this were to be the case, then I would not usually refund postage. I think, therefore, it would be helpful if you could spare five minutes to find the engine number so we can check what has happened. The Unipart catalogue gives details of applications as being to and from certain engine numbers so I think this woudl have been given to ensure the correct parts are matched to relevant engines. Sorry about all these e-mails but I do not have your phone number. Many thanks, Best Wishes, Robert 020-8570 2671 If the customer will not engage with me, then I would ask if this matter be escalated to a formal dispute procedure. Thank you. Robert Elliott

To PayPal #3: My terms and conditions of sale on eBay are compliant with the requirements of the Distance Selling Regulations. Thank you. Robert Elliott 020-8570 2671 Now follows a transcript of an e-mail sent to the customer on 9th June. Hello, This is Robert again - smokyq from eBay. Thanks for your messages. Given that we have had a problem with the first attempt to supply you with a water pump, I would not like to compound the problem by doing the same again. If you are not able to give me the engine number, then it might be better for me not to try to supply a replacement and for you to look for one somewhere else. Regarding a refund, the refund position on everything I sell is as follows: • Refunds on eBay list prices or auction final values are available for any item irrespective of reason for purchaser not wanting the item (including change of mind) provided that the item is returned to me in the same condition that it went out in. So I would be happy to refund the list price that you paid. • Regarding post and packing, the general principle is that if I have made a mistake in the listing or sent you somebody else's purchase by mistake or have made some other error, then liability for postage both ways is with myself. If I have not made a mistake but the purchaser has made a mistake or has had a change of mind, then in general the liability for postage rests with the purchaser. To be continued in a fourth message.

To PayPal continued #2. I believe that the problem is that the customer did not check the engine number on his car against the number given in my listing and that he has the wrong engine for my water pump. I have asked for his engine number so that I can find out what has gone wrong but he has not supplied this. It would take only a few minutes to get the engine number. The customer has advised in a previous communication that the engine in his car has been changed and I think that this is part of the problem. He should have checked his engine number against the engine number range given in my listing before buying. At present, I am happy to refund the list price once the pump is returned to me but not the postage costs because it looks as if the customer has made the mistake. If the customer thinks that I have made the mistake, then he needs to engage with me and to show me what I have done wrong. Until he has done that, I do not wish to refund the postage costs. If the customer can show to me that I have made a mistake, then I would take the responsibility for any mistake on my part and refund the postage costs. I would suggest that the customer continues to engage with myself to clarify all the facts of the situation before referring to PayPal. The process of trying to clarify exactly what has gone wrong has not yet been completed and it is premature therefore for him to refer to yourselves at this stage. If this turns into a dispute, the resolution will be achieved by obtaining the engine number details for his car from DVLA who would be the independent third party providing the factual information that shows which side has made a mistake. To be continued in a third message.

To PayPal; Your message system limits the number of words in a message so I will have to spread my reply across several messages. A copy of my last communication to the customer will be copied and pasted to the PayPal message system. The customer has not responded to this as requested The customer has been sent a copy of the Unipart catalogue vehicle application details. These come from the Unipart catalogue. Unipart is the manufacturer of the water pump which the customer purchased. I am happy to send a copy of this to PayPal also. My terms and conditions are that I will refund list price on all items if returned to me in same condition as sent out for whatever reason including customer changing his mind. If I have made a mistake with the listing or order, then I pay for postage costs both ways. If the customer has made a mistake, then the customer pays for postage costs both ways. The customer has gone to PayPal whilst I have still been trying to resolve the situation with him. I sent him the water pump that was listed in the eBay listing and which was shown in the picture in the eBay listing. I have double checked the vehicle application details in my eBay listing against the details given in the Unipart catalogue. I copied across the information in the Unipart catalogue to my eBay listing correctly and without error. It is not correct, therefore, to say that the water pump that I sent the customer is significantly not as described. I sent him the water pump that was described and shown in the eBay listing and for which the vehicle application details are as shown in the Unipart catalogue. This repsonse will be continued in a further message.
