No banned means he gets banned for weeks/months and doubtfully years.
What he wants is to have it revoked, he can re-sit and be back on the road within a month.
Tbh, He'll get told to stop being a dick, slow down and hit with a fine i reckon.
38 in a 30 isnt a massive crime.

Forgot to add, i done something very silly involving a car in october last year, worried about it for months due the extreme of it, Feb came , i got 2 points and a 250 fine.
This was far more serious than speeding , i could pm you what i done if you like but i just dont want people to know what i done as im not proud of it.
All im saying is, mines was really bad and i got off lightly, your mates went a few mph over. Just tell him not to worry too much as he might get a fine and told to behave, But dont get your hopes up incase he gets banned.

explain to the judge its going to affect his career if he bans him and hopfully the judge will put him up to maximum points which is 6 and he still can drive around.
m8 had this on a moped not sure if its the same

6points in 2yrs doesnt mean a ban!!!
If he goes to court and gets another 3 points the dvla will revoke his license. He isnt banned, he simply goes back to learner status unless the court actually ban him which isnt going to happen as its a minor speeding offence.
Tell your mate once he loses his license he can re-apply straight away and resit his theory and practical straight away.

yeah but you have to wait on the license getting sent back and then waiting on the new 1 arriving then theres the waiting time for the theory test and the practical. i know as this has happened to me.
even if you stretch it out passed the 2 years the points are based on the date of offence.
I think the your mate should go in and confess all, plead with the judge, tell him it will affect his career to lose his license but he admits he is in the wrong and that he has learned from his mistakes and would accept a larger fine for him to be lenient with the points.

my mate just got caught speeding a week after he got 3 points on his phone, he paid to take some kind of driving test which allowed him not to take points which i thought was cool

mates dad was a courier.. and got like 15 points on his license.. cause he needed his license for his job to keep a living.. and the judge took this in and let him get away with it .. 15 points and still has his licence 
tell the judge that u NEED the license for work.. then see what he says..

Its not based on the date of the offence, the date is stamped on when the points are stamped on , how can they apply points back in time?
He can stretch it for a month and it'll be fine, had this confirmed today. (scottish law though)

He has been to see the boss at his new job this morning.
He said that if he does get banned, it's ok with him coz it was just a minor speeding offence and not something like drink driving.
So he will still have a job. 
But he doesn't know how he's going to get there. There isn't any bus routes.... and i'm not taking him.

Boy i work with got 6 points within two years. He kept not sending the letters back that he was getting and dragged it out past his two year mark. Went to court, got our boss to write a letter saying he needs his licsence for work and all he got was a week long ban and £150 fine. Jammy git.

I got done last ocotber and points went on in Febuary, it stamped with the source code and date.

Don't condone what I did or anything, but I'm just a jammy cunt...
Got pulled on the motorway for doing well over a ton a few years back... Was easy +50mph over the limit...
Got chatting to the officer who pulled me quite well, and managed to get away with just 3 points on an SP50...
VERY LUCKY!!
Should of been a Ban imho...
Motorway was completely empty though, massive long straight, and just me and the 'Black Vectra GSi'...

my good mate (had 5 points already) got caught speeding in Oct 06 and was due to be driving 2 years at start of December. Dragged it out til January and got 3 more points. Thus totalling 8 points but the extra 3 were added from the date of offence meaning he tallied over 6 points in his first 2 years and had his license revoked. FACT!
could be different laws in different areas... Dont know?
