I saw an accident yesterday morning on the way to work, and it got me thinking. Heres the story:
I was following an oldish guy in a Subaru round the back lanes to my work, he was driving like a complete and utter tit. They are nice lanes, but a bit hairy in places. He was cutting blind bends, and easily topped 100 down the straight. (I was doing 80 and he left me for dead)
He did a left, and a guy pulled out about 200 yards from the junction out of a farmyard. The Subaru hit the back wheel area of the Suzuki, and spun both cars around 180 degrees. As the Subaru hit the back of the Suzuki, i'm thinking he was nearly on his side of the road.
The lad said he didn't even see the Subaru when he looked (slight bend).
Do you think it would be possible for him to get 50/50 from the insurance?

I think that would all depend on the evidence he has ?
i.e you were a witness but were there others ?

Suzuki had entered Subarus path but witness statement would be enough to sway it the other way.
Did the Suzuki driver do EVERYTHING correctly and most cautiously?

Are you a witness or did you bugger off? This is one reason why most witnesses never stay at the scene of accidents because it leads to grief.

GTI - I was the only witness, apart from the two lads in the Suzuki.
Ian - IMO, he did do everything correctly. As said above, he was nearly on his side of the road. The damage is well behind the drivers door. I think he didn't see it when he looked as it wasn't in view, and the guy was going so fast he came on him quickly.
Ed - When i stopped, i got out to remove some STI bumper from my path. I gave the guy a rollocking, he could have easily killed somone round there doing the speeds he was. I left my number with the lad, and told him to pass it on if he wants to contest it.
The cheeky bastard told me he never exceeded the speed limit. I know thats bull.

I had a witness to a crash 2 years ago, when the insurance came to contact him he said he was too busy.
