While this is not UK law and therefore doesn't directly affect this web site, its close enough for me to worry me a bit. I'm quite happy with the state of moderation at present and don't really feel it needs any immediate work, but I would ask that every considers that they have two responsibilities under this new ruling, firstly to not post anything too bad but secondly and most importantly to make a member of the moderation team aware if anything needs looking at.

The underlying tone of that ruling is basically that sites should have someone on hand 24 hours a day, which is a problem as thats actually rather impossible unless we're employing people properly. As we don't, I'll settle for people not dicking about while there's no staff on. The choice is that or we close when the mods go to bed, which is not somewhere I want to go.

Unless certain trouble makers are dealt with Ian, I can see this becomming an increasing issue in the future.

Still, its another step forward to restricting peoples freedom of speech rights!

Its all about risk, yes.

It doesn't affect us yet, but it will only need one forum to go to court to seal the deal for this country as well.

Thats not a new thing, forum staff have always been liable, its just that in the past you were OK so long as made efforts to remove stuff which you were aware of.

This ruling means you have to go looking for it as well, not knowing about stuff isn't a defence.

cant you do something with a modbot type set up to pick up on certain words/ topics and alert you Ian?

i know thats not ideal, but its cheaper than paying people to moderate permanently

No not really.

The case started with a forum member of German news site Heise Online, who posted a script in order to disrupt the business practices of Universal Boards. This Munich company has been widely criticised for allegedly distributing premium rate internet dialers. Universal Boards was also accused of buying up domain names that expired, and then using those domains for advertising porn, including a site that was previously owned by a German Volunteer Firemen's Association.

This is hardly a news site is it???

And as for buying expired domain names for advertising pron they deserve to be 'disrupted'

Sounds like german legal stupidity imo

The bit that worried me was this:

quote:
The new ruling means if operators do not have enough in-house resources to monitor forums, they should "reduce the scope of their business operations".
