i sold a fiesta to a woman yesterday. she test drove it said she wanted it. so i gave her a receipt with the car details on and the price i sold it for and also put sold as seen on the bottom. get a phone call about 10 mins ago saying the gearbox has gone on the car and that i knew about it and said she is taking me to court..

what would u do? give her the money back or would u tell her to get fcuked


before anyone starts having a go i did not know about the gearbox

if you have a copy of the receipt with the sold as seen and her signature on it then nothing she can do

hmm to repair the gearbox it will cost a good couple of hundred..the woman who bought the car has always been use to automatics. i reckon she has burnt the clutch out and presumed the gearbox has gone because she cannot get it into gear

Oh, sold as seen, in that case tell her to get stuffed.

If you hadnt put that then she coulda had something against you in terms of selling merchantable goods or something, but I dont think she has a case.

Maybe to avoid the hassle, offer to pay half to sort the thing out.

yea its a legal document and it will hold up in court. b4 u decide to do anything phone citizen avice bereau and find out where you stand. show him the documents n take it from there. since it was not ur fault.

id just leave it mate, sold as seen means exactly that

if she didnt bring a mechanic to check the car out thats her loss, no longer your problem

tell her NAE LUCK...these things happen...sold as seen means exactly that, she is trying it on..

When i sold my green corsa the timing belt went not long after, Scott Mckenzie off here didn't get at me to give him a refund...

sorry but 'sold as seen' means nothing in a legal point of view, however if you genuinely didnt know about a problem with the gearbox then it aint your fault and surely she shouldve realised this when she test drove it...tough luck i say

i am just saying that she signed something in agreement that she was getting something which is sold as seen by the buyer... no grantueed was offered if something went wrong...

so that document she singed is in accordance with that

yeh i see what your saying but for example if i sold a car with bad brakes and wrote 'sold as seen', it could be deemed as a legal no-no and you could get problems....thats all im saying matey

1997 p reg fiesta (newer shape)
100,000 miles with history
excellent condition
sold it for £600

Are you a trader or private individual?

Goods must be fit for purpose which means a reasonable period of trouble-free use. While you're not legally required to offer a warrenty with the car, you do have obligations under Sale of Goods Act.
