Bought an item off Ebay about 2 1/2 weeks ago. Been on holiday for the last 2 weeks so been a bit stuck chasing it up.
The thing is the item was sent first class, forgot to sort out recorded delivery as I was leaving the country the day I paid for the item. I have tried chasing my local dispatch office and they have said that there is no item waiting for collection and that if no note was passed through the door then it was never attempted to be delivered meaning it was never sent.
Am I right to think that the person who sent me the item should have proof of postage and if they do not then I can claim the money back??

should have some sort of reciept for the postage I would imagine. This is why you should ALWAYS get recorded delivery. Tell the guy who sent it you havent recieved it yet and see what he/she says.
What is the item btw?

Yeah I have now learnt my lesson about recorded delivery, but as I say with the rush I had on to sort so many things before I left the country for 2 weeks I didnt give it the full attention it deserved.
The item is a pair of jeans, not something that would easily post through your letter box, so I would have thought that they would be returned to the local dispatch office, yet that office assures me that they have no parcels for my address waiting to be collected.
It worries me though that if people guess the item is clothing it isn't difficult for Mr Postie to teef it.

Ah right, the thing is I have contacted the guy and explained the situation and he hasn't said anything about it being returned to him. Cheers for the info PaulW very helpfull.

Didnt even get a card through thats the thing, and the place it was delivered to is my moneys business address where there is pretty much someone there from 7:30am till 6pm every day.
I am starting to get the feeling now that I have been conned. That the item was never actually sent etc. But as of yet I am waiting for a reply from the sender regarding the matter of proof of purchase.

just ask for the recorded delivery number. If he cant provide this, if you paid via paypal then you can claim your money back.
Ally had the money taken out of her account automatically and sent back to a girl that bought something off her, even though she provided the recorded delivery number to Paypal. Paypal admitted it was their mistake because they didnt know how to use the royal mail site to check it

Thats the tihing mate, it wasn't recorded, it was just standard First Class mail, that was sent over 2 weeks ago (allegedly) and still hasn't arrived.

I have got a reply from him and he sates that he has no proof of postage/sending. Surely if he cannot prove that the item has been posted then I can claim the funds back??

i think he's having you on mate.you get a receipt with any parcel you post at the post office.most things i send i use standard delivery and you still get a number for the delivery

chewy is right you get a reciept for anything you send.
Any decent seller would keep the reciept until the buyer had the item and it was all sorted.
He may well be conning you.

Even if the package is sent first class only, no special delivery. Just a matter of putting the right amount of stamps on for the weight. Would that still have a proof of postage?? I am sure he would be able to request proof would he not??
If thats the case then I will be contacting paypal to get my money back, and ebay to report him. I have been nothing but pleasent with the guy and he has been really off hand and arsy with me.

Anyone able to confirm for certain. I need some solid info so that I can go to Ebay about the matter without worrying they are going to turn round and tell me he was right.

if it was a parcel, when u go to the post office now they print out a sticker with the postage amount, they dont use stamps. you can ask for proof of postage or a receipt, which they sometimes give you anyway, but not always.

in my experience posting (mainly ebay stuff) you get a reciept for whatever you post usually.
some items i post first class and the reciept covers you upto £28 for loss/damage
learnt my lesson now tho over a damaged item worth more than £28 posted first class and now post recorded if i can

I will now be chasing him through paypal to recover the money, he has no proof of delivery so cannot argue with the matter. I will also be reporting him to ebay for his poor attitude, and will leave him bad feedback. He was asking me to leave feedback before the item had been recieved which I thought was a bit fishy.
I feel like I am being a bit of a bastard because he is now loosing out on £60, yet if he is foolish enough to not request proof of postage then it is his own fault.
I will learn for the future to only use recorded delivery.

I always insist on a "signed for" delivery with items over £10, I've been let down by the Post Office so many times in the past - recorded doesn't give you any more comeback, but at least gives you a little receipt you can hold close and cry over at night.
