If it is still of the rear axel a little get an old bike tyre and cut a 20 cm length and cable tie it to the rear beem.

turn the clamp 90 degrees so the nuts face away from the axle this puts the thinnest part of the clam near the axle, if not undo the clamp and rotate the back box slighty and this will lift the pipe up away from the axle cos of the bend in it

It looks like its the clamp used to attach the back box to the rest of the system, i've looked in the max power haynes and its says to get a 'band clamp', anyone know if this is a decent solution or any other ideas, thanks
