What have I missed? Or is it just because I've not got the green writing?

If you have Legal Assistance they'll deal with it for you.

I rear ended one person that then hit another. The 2nd car hit put in a claim right before the 3 years were up. They had all this evidence and it was a letter from a solicitors in Newcastle, no where near where we live.

Gave the documents to the insurer at the time and was all sorted from there. Got a letter from my insurance company's solicitor saying I was at fault, signed, then all settled out of court.

Dnt think I have Legal Assistance, just got the cheapest deal I could and I'm still spending £800 a year on a 1.2!

Too much money in my motoring career these days, even considering coming off the road for a while, but thats probably just me getting annoyed over this case.

On a side note I'm heading out here to try and start the thing after its sat under 4 inches of snow from Thursday. Fingers crossed lol

Thanks for replys.

That was funny, and yes id say it was avoidable in the hands of a capable driver.

I work in insurance in the claims department and do this all day

Incorrect.
You can deny negligence but admit to a breach of a duty of care. A court does not need an admission of negligence to find for a Claimant. A breach of a duty of care is enough.

To be honest, I would kick up utter fuck if someone crashed into my car, no matter if they slid due to any condition and there insurance said the conditions were to blaime so your car isnt getting fixed

Best of it was, she didnt even think to jump in (which she had plenty of time to do) but tried to pull the car back instead

Normal for the Claimant's name and address to be included on a Claim Form or Letter of Claim.

Even if you don't have Legal Assistance your Insurer under s151/152 of the Road Traffic Act 1988 has to satisfy any judgment obtained against you.

Your Insurer will have a panel of solicitors working for them. Once the Claimant issues his claim no doubt one of the firms on the panel will take over.
