should have been banned. fuck it u shoulda gone to prison. my mate was sent for 5 years for doing over 90 and u were a heartless twat about it.

go court again and get what u deserve.

Did your mate get sent to jail for soley doing over 90?

not really. he didnt cause a crash he was speeding. anyways got a new legal team now thanx to some car mags, its going well new evidnece n stuff and witnesses. lookin good.

I personally wouldn't appeal, nowhere have you said that you were actually not doing that speed.

As i understand it, there are 2 forms of appeal that i could take..

First would be a re run of the trial infront of a higher court but would give the prosecution the chance to rectify any errors in their case (quite easy now considering i've revealed my defence) and isn't really much good to me (i'm sure everyone knows why by now).

Second form of appeal would be a judicial review which is an appeal based on one single discrepancy in law. If i were to take this option, i would seek confirmation that the evidence used to convict me was valid. Only downfall of this would be extremely high costs involved.

If you can afford the increase in insurance, and I assume that is quite a bit cheaper than the legal costs of taking it further, you might as well just cut your losses and be extremely carefull with your speed for the next few years.

The evidence used to convict you certainly wasn't valid, it had timed out.

However, it would fall to you that you were not driving on that road at that time, or that if you were, you were not driving in excess of the speed limit. It would only take a statement from the officer at the scene to say that you were, and even if the judgement of speed was deemed inaccurate, you could still be convicted of a lesser offence.

Just take it and look happy.

I don't think judicial review works like that...

I bring up a point of law which i wish to appeal against, they review it. They rule in my favour and conviction is quashed as i understand it..

That is certainly not worthy of a Judicial Review. There is not even an abuse of process.

As for your mate getting 5 years, until I had read the full case file I wouldn't offer any sympathy, as I'd want to know the truth, not your opinion what went on

you cannot JR your conviction for speeding!

You wont even get granted permission to appeal because its not classed as being of overwhelming or significant importance!

the thing is, appeal or whatever, and every cop within 50 miles will be watching your ass 24/7

say goodbye to driving ANYTHING over the limit, having a bulb out, etc

they will make your life hell. u will never get one over the police, they will always win

Read all your post Marc not read the 3 pages though...

I think you have got off with a ban and be happy...6 points and £350 at £7.50 a week is not bad.

As you say maybe could have been thrown out due to the misleading etc but if it was me I'd be chuffed..

Forget it now, get on with getting the veccy to mint condition

Did he not plead guilty to causing death by dangerous driving or something similar? Then cry when he got found guilty? Or am i thinking of a different case!

The appeal is focused on the procedures and validity of evidence used rather than the type of equipment used..

im glad its all ova 4ya mate. i fink u prob got of lightly in one way as nethin over 100mph is a ban but it woz harsh 2give u points and a fine if there isnt enough proof 2send u down 4 it.
